How to file complaint on police

A lot of individuals question me and ask me that is it possible to launch a complaint against the police? we see in movies the police officers are shown overpowered. There must be a question in the mind of every individual what are the limits of the power of police is it unlimited like movies? or is it something to check and balance their power.  The answer to this question is Article 14 of the Indian Constitution the rule of law which says that there is equality before the law.

How to file a complaint against the police?

one can file a criminal complaint as well as a suit for damages (civil) on the police.

There are two ways from which you can complain against police

  1. Filling via legal experts/ or advocate:– The advocates/legal experts have knowledge of law so they can also site valid legal points in complaint application so it has been observed that the complaint itself makes a lot of difference and the higher official will work on that complaint as per law.   2. Self-filling of Complaint: If you still want to file yourself you can also do it. It can be done after following the steps mentioned below:-

If you want to just file a criminal complaint file a complaint in writing to the higher police officer and if such a higher police officer doesn’t do anything on your complaint then you can approach the “ILAQA” magistrate or “ON DUTY” magistrate under section 156(3) of The Code of Criminal Procedure, 1973.

One can also file Civil Suit on Such a police officer for a suit for damages:-

To file suit for damages one needs to issue notice first then damages can be claimed from that suit. You can get this complaint drafted by your advocate after complying with all procedures of CPC,
