1. The petitioner is seeking the concession of anticipatory

bail under Section 438 of the Cr.P.C. in case FIR No.308 dated

28.11.2023 under Sections 307, 326 of the IPC and Section 25 of the

Arms Act, 1959 registered at Police Station Jandiala, District Amritsar.

2. On the 08.01.2024, while noticing the following

submissions made by the learned counsel for the petitioner, this Court

had granted the concession of interim bail to the petitioner and asked

him to join investigation:-

“Learned counsel inter alia submits that the
petitioner has been falsely implicated in the case in hand
and in fact, the petitioner also suffered injuries in the
occurrence in question while he was standing on the roof
of a house. Learned counsel further submits that even as
per the allegations levelled in the FIR, the petitioner was
not armed with any weapon, much less firearm. On a
pointed query put to the learned counsel as to whether the
petitioner was involved in any other criminal case, he has
replied in the negative.”

3. Learned counsel for the petitioner submits that in

compliance of order dated 08.01.2024, the petitioner has joined

investigation and cooperated with the investigating agency.

4. Learned State counsel, on instructions from ASI Chanchal

Masih, does not dispute the factum of the petitioner having joined

investigation and cooperated with the investigating agency. He, on

further instructions, submits that the petitioner is not required for

further investigation much less for his custodial interrogation.

5. In view of the above, the petition is allowed and interim

order dated 08.01.2024, is made absolute subject to the conditions laid

down in Section 438(2) Cr.P.C.

6. Pending applications, if any, stand disposed of.
