Prayer in the present petition is for issuance of direction to
respondent No.2 to refer the dispute to an Arbitrator in terms of Clause 41 of
the Assisted Sector Agreement (Annexure P-1) to decide the dispute
between the parties.

It has been informed that due notices have been issued to the
concerned parties, however, there is no representation on their behalf.

The dispute/controversy was in relation to the reference of the
matter to Arbitrator in terms of Clause 41 of the Assisted Sector Agreement.
The period of nearly two decades have been elapsed.

It is not seen that the dispute would have remained pending or
would have survived in this duration. The present petition is disposed of as
having been rendered infructuous at this stage.

Liberty is however granted to the parties to seek revival of the
present petition, if any grievance still survives.

All other civil misc. applications, if any, stands disposed of.
