1. By this common order, three writ petitions, the details of

which have been given in the heading, are being decided as all these

petitions involve the same question of law on similar facts.

2. The present petitions have been filed for quashing the

impugned list of the candidates shortlisted to appear for the written

examination/skill test for Group-1 and Group-2 (Annexures P-6 and P-7)

on the ground that the petitioners have not been shortlisted for the same

despite clearing the common eligibility test (hereinafter referred to as

‘CET’)

3. Learned counsel for the petitioners argue that the grievance

of the petitioners is that though they have cleared the CET but they are

not being called for the written examination for the post of Group-1 and

Group-2. Learned counsel for the petitioners submits that as per the

criteria which was circulated, keeping in view the number of posts, the

candidates were to be called for the written examination. Learned

counsel for the petitioners argue that if the posts were less than 30, five

times the candidates are to be called for written examination and if the

posts are between 30 to 40, 150 candidates are to be called for the written

test and if the posts are above 40 then 04 times of the number of posts,

candidates are to be called for written examination and keeping in view

the number of vacancies, which have been reserved in the General

Category qua the post against which the petitioners are competing, the

petitioners are within the 04 times of the number of posts but still they are

not being called for the written examination, which is causing prejudice.

4. Notice of motion.

5. On the asking of the Court, Ms. Shruti Jain Goel, learned

Senior Deputy Advocate General, Haryana, who is present in Court,

accepts notice on behalf of the respondents.

6. Learned State counsel submits that keeping in view the

Instructions, which have been supplied to her, keeping in view the

judgment passed by a Co-ordinate Bench in CWP No. 23917 of 2023,

decided on 08.01.2024, list of the candidates who are entitled to be called

for written test as per the said judgment was prepared but now operation

of the said judgment has been stayed by the Division Bench in LPA No.

329 of 2024, whereby the list of eligibile candidates to be called for

written examination fixed for 18.02.2024 in each category is being re-

determined and the candidates, who have cleared the CET, will be called

for written examination keeping in view the initial criteria given and the

fresh list of eligible candidates to be called for written examination fixed

for 18.02.2024 will be completed within a next five hours so that the Roll

Number of the candidates, who are to be allowed to appear in the written

examination to be held on 18.02.2024, will be displayed on the website of

the Commission today itself by 8.00 p.m.

7. Learned counsel for the respondents submits that in case, the

name of the petitioners appears in the revised list of the candidates to be

called for the examination, which list will be issued today, the petitioners

will be called to appear in the said written examination and all the efforts

will be made to issue the Roll Numbers to the candidates as per the

revised list. Learned counsel for the respondents further submits that in

case the name of the petitioners appears in the revised list they will be

allowed to appear in the written examination but in case, on any account

the Roll Number is not issued to the petitioners then also the petitioners

will be allowed to appear in the written examination by producing the

present order passed by this Court today.

8. Learned counsel for the petitioners submits that keeping in

view the statement of learned State counsel, the present petitions may

kindly be disposed of having been rendered infructuous and the same may

kindly be disposed of as such.

9. Ordered accordingly.

A photocopy of this order be placed on the file of connected

cases.
